These Terms of Service ("Terms") govern your use of the SpeakFair platform ("Service") operated by SpeakFair ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using SpeakFair, you confirm that you have read, understood, and agree to these Terms. If you are using SpeakFair on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
SpeakFair is an AI-powered meeting analysis platform that processes audio recordings to generate communication analytics, including speaking equity scores, interruption analysis, participation metrics, and coaching recommendations. The Service is provided on a software-as-a-service (SaaS) basis.
3. Account Registration
- Access to SpeakFair is by invitation only. You must receive an invitation from an organization administrator to create an account
- You are responsible for maintaining the confidentiality of your password and account credentials
- You must provide accurate information when creating your account
- You must notify us immediately of any unauthorized use of your account
- You may not share your account credentials with others or allow others to access your account
4. Acceptable Use
You agree to use SpeakFair only for lawful purposes and in accordance with these Terms. You agree not to:
- Upload recordings without the consent of all participants, where required by applicable law
- Use the Service to monitor, surveil, or discriminate against individuals
- Attempt to access other users' data, transcripts, or analyses
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to develop a competing product
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Interfere with or disrupt the Service or servers connected to the Service
- Exceed your organization's licensed user count
5. Recording Consent
You are solely responsible for obtaining appropriate consent from all meeting participants before uploading recordings to SpeakFair. Recording consent laws vary by jurisdiction. Some jurisdictions require all-party consent for recording conversations. It is your responsibility to understand and comply with applicable laws.
SpeakFair is not responsible for any recordings uploaded without proper consent.
6. Intellectual Property
Your Content
You retain all ownership rights to the audio recordings, transcripts, and data you upload to SpeakFair. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (transcription, analysis, and score generation).
Our Service
The SpeakFair platform, including its design, code, algorithms, scoring frameworks (including the SpeakFair Equity Score and Psychological Safety Index), documentation, and branding, is the intellectual property of SpeakFair and is protected by applicable copyright, trademark, and other intellectual property laws.
The SpeakFair Equity Score™ is a trademark of SpeakFair.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:
- We do not sell your data
- Managers and administrators can only see aggregate scores, never individual transcripts
- You can export or delete your data at any time
- We use industry-standard encryption and security practices
8. Organization Accounts
If you access SpeakFair through an organization:
- Your organization's administrator manages user accounts and access
- Your organization may have its own policies regarding meeting recording and analysis
- Your administrator can remove your access, which may result in deletion of your data
- License counts are managed at the organization level
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may occasionally need to perform maintenance, updates, or experience outages beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
10. AI Analysis Disclaimer
SpeakFair's AI analysis is provided for informational and coaching purposes only. While we strive for accuracy, AI-generated insights may contain errors or misinterpretations. Specifically:
- Speaker identification may not always be accurate
- Interruption classification (collaborative vs. dismissive) is based on linguistic patterns and may not capture full context
- Scores and metrics are indicators, not definitive assessments of individual capability or character
- Analysis should be used as one input for coaching conversations, not as the sole basis for employment decisions
SpeakFair should not be used as the sole basis for any employment, promotion, disciplinary, or legal decision.
11. Limitation of Liability
To the maximum extent permitted by applicable law, SpeakFair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Account Termination
- By you: You may delete your account at any time through the Settings page. This permanently removes all your data
- By your organization: Your organization administrator may remove your access at any time
- By us: We may suspend or terminate your account if you violate these Terms, with notice where practicable
Upon termination, your right to use the Service ceases immediately. We recommend exporting your data before deleting your account.
14. Changes to Terms
We may modify these Terms from time to time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by email notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
